Article 274
Amendment of the Constitution
: (1) This Constitution cannot be amended in such a way as to be detrimental to Nepal's sovereignty, geographical integrity, independence and sovereignty vested in the people.
(2) Subject to sub-section (1) and other articles of this Constitution, a bill to amend or repeal any article of this Constitution may be introduced in any House of the Federal Parliament. But sub-section (1) shall not be amended (3) The bill introduced in accordance with sub-section (2) shall be publicly published for the information of the general public within thirty days of its presentation in the concerned house.
(4) If the bill introduced in accordance with sub-section (2) is related to the change of the boundaries of a province or the matter mentioned in Schedule-6, the speaker or the chairman of the relevant house shall send it to the provincial assembly for approval within thirty days after such bill is presented in the Federal Parliament.
(5) The bill sent in accordance with sub-section (4) shall be approved or rejected by the majority of the members of the relevant Provincial Assembly within three months and the information thereof shall be sent to the Federal Parliament. But in the case that no provincial assembly is in existence, such provincial assembly must be approved or rejected within three months from the date of its first meeting.
(6) If information is not given that such bill has been accepted or rejected within the period as per sub-section (5), the House of Federal Parliament where the bill originates will not be hindered from proceeding with such bill.
(7) Within the period as per sub-section (5), if the relevant House of the Federal Parliament is informed that the majority of the Provincial Assembly has rejected such a bill, such bill shall become inactive.
(8) A bill that does not require the consent of the Provincial Assembly or has been approved by a majority of the Provincial Assembly in accordance with clause (5) shall be passed by a majority of at least two-thirds of the total number of members immediately existing in both houses of the Federal Parliament.
(9) The bill passed in accordance with sub-section (8) shall be submitted to the President for verification.
(10) The President shall certify the bill submitted in accordance with sub-section (9) within fifteen days of receipt and the Constitution shall be amended from the date of certification.
